Terms of Service

These Terms govern your use of newcenturytutoring.com and the tutoring services provided by New Century Tutoring, owned and operated by Dewey Potts in Utah ("we," "us," or "our"). By using the website or enrolling a student, you agree to these Terms. If you are enrolling a student, you confirm that you are the student's parent or legal guardian, or are otherwise authorized to enroll them.

Our services

We provide one-on-one online tutoring through video conferencing (such as Zoom). After a free consultation, we match your student with a tutor and schedule regular sessions. Session length, frequency, and pricing are those agreed with you when you enroll.

Monthly plans and billing

• Tutoring plans are billed monthly in advance and renew automatically each month until paused or canceled.
• By enrolling, you authorize us (through our payment processor, Stripe) to charge the card or bank account you provide each month for your plan's price, including any discount shown at enrollment.
• We may change plan prices with at least 30 days' notice. The new price applies starting with your next billing date after the notice period.
• If a payment fails, we'll reach out to resolve it. Sessions may be paused until the account is current.

Pausing and canceling

You may pause your plan (for example, for summer or a vacation) or cancel at any time by calling, texting, or emailing us. Changes take effect at the start of your next billing period unless we agree otherwise. You will not be charged for months while your plan is paused.

Missed sessions and refunds

If your student has to miss a session for whatever reason (things happen!), we will give you a credit to make up the session another week during the school year. If we need to cancel a session, we will reschedule it or credit your account. Monthly payments are otherwise non-refundable, but if you have a concern about a charge, please contact us and we'll work with you to make it right.

Equipment and shipping

All tutoring takes place online. Students will need a computer with internet access and a digital writing pad, which they can purchase on their own or New Century Tutoring will send them one. If New Century Tutoring sends the digital writing pad, the customer pays for the pad and all shipping and handling costs.

Free practice exams, analysis, and consultations are offered without obligation. Practice exam analysis is for guidance only.

Our commitment and results

We are committed to your student's success: we carefully match tutors, communicate regularly with parents, and send monthly progress reports. Because learning outcomes also depend on factors outside our control, such as attendance, effort, and the student's school, we cannot guarantee any specific grade, score, or admission result.

Conduct

We expect respectful behavior from students, families, and tutors. We may end services for conduct that is abusive, unsafe, or disruptive, and will refund any prepaid, unused portion of the current month.

SMS Terms

By giving us your phone number or email, you agree that New Century Tutoring may contact you by call, text, or email about your inquiry, scheduling, billing, and your student's progress.

New Century Tutoring text messages: conversational and account messages about your inquiry and tutoring. Message frequency varies. Message and data rates may apply. Reply HELP for help. Owner inquiry alerts: separately, the business owner receives automated text notifications of new website inquiries from (385) 444-7547, as described on our SMS alerts page. Message and data rates may apply. Reply HELP for help, STOP to opt out.

Website use

This website provides information about our online tutoring services. You agree not to misuse it, for example by submitting false information, spam, or attempting to disrupt the site. Website content is owned by New Century Tutoring and may not be copied for commercial use without permission.

Limitation of liability

To the fullest extent permitted by law, New Century Tutoring is not liable for indirect, incidental, or consequential damages arising from use of the website or services. Our total liability for any claim is limited to the amount you paid us for services in the three months before the claim arose.

Governing law

These Terms are governed by the laws of the State of Utah.

Changes to these Terms

We may update these Terms from time to time. The effective date at the top shows when they were last changed. Continued use of our services after a change means you accept the updated Terms.
